Terms of Service

1. Acceptance of Terms

By accessing or using Branch & Bond (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of those changes.

2. Service Description

Branch & Bond is a platform that transforms genealogy data into beautiful, print-ready family tree artwork. Users may import family data manually or through third-party services such as FamilySearch, customize artwork designs, and purchase digital downloads or physical prints of their family trees.

3. User Accounts

When you create an account with Branch & Bond, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Branch & Bond is not liable for any loss arising from unauthorized access to your account.

4. FamilySearch Data Restrictions

Data imported from FamilySearch is provided under the terms of the FamilySearch API agreement and is subject to the following restrictions:

• FamilySearch data is for personal, non-commercial end-user use only.
• You may not resell, lease, sublicense, or redistribute raw FamilySearch data in any form.
• You may not export FamilySearch data in bulk or use the Service to build datasets from FamilySearch content.
• Derivative artwork (fan charts, printed artwork, and other visual designs) created from your own family data is permitted for personal use.
• Branch & Bond may be required to remove FamilySearch-sourced content at any time upon request from FamilySearch. You acknowledge and accept this possibility.

5. Acceptable Use

You agree not to:

• Use robots, spiders, scrapers, or any automated means to access the Service or its data.
• Attempt to reverse engineer, decompile, or disassemble any portion of the Service.
• Export data in bulk or use the Service for any purpose other than personal family history use.
• Circumvent any rate limits, access controls, or security measures implemented by the Service.
• Use the Service in any way that violates applicable laws or regulations.

6. E-Commerce and Purchases

Branch & Bond offers digital downloads and physical printed products for purchase. By placing an order, you agree to the following:

• All prices are listed in United States Dollars (USD).
• All sales of digital downloads are final. Due to the nature of digital goods, digital purchases are non-refundable.
• Physical products are fulfilled by our printing partner, Printful. Physical orders are subject to Printful’s fulfillment, shipping, and return policies.
• You are responsible for providing accurate shipping information. Branch & Bond is not liable for orders shipped to incorrect addresses provided by the customer.

7. Refund Policy

• Digital downloads are non-refundable once the download link has been delivered.
• Physical products may be returned or replaced if they arrive defective or damaged, in accordance with Printful’s return and replacement policies.
• To request a refund or replacement for a defective physical product, please contact us within 30 days of receiving your order.

8. Intellectual Property

• The Branch & Bond platform, including its design, code, and artwork templates, is the intellectual property of Branch & Bond.
• You retain ownership of your family data. By using the Service, you grant Branch & Bond a limited license to process your data solely for the purpose of generating your artwork.
• Artwork designs generated through the Service are licensed to you for personal use only. You may print and display artwork for yourself and your family but may not resell or commercially distribute the designs.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Branch & Bond and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. In no event shall Branch & Bond’s total liability exceed the amount you have paid to Branch & Bond in the twelve (12) months preceding the event giving rise to the claim.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

Branch & Bond reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we determine to be harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately, and any FamilySearch-sourced data associated with your account may be deleted.

11. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will notify users by updating the “Last updated” date at the top of this page and, where appropriate, providing additional notice through the Service. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Utah.
